सर्बोच्च अदालतको फैसला नमान्ने @ShahBalen को घोषणालाई धेरैले आलोचना गरे। कानूनी शासनमा अदालतको निर्णय मान्नु पर्छ। तर जब राज्यले कानूनी शासनको नैतिक धरातल गुमाउँछ, न्यायलयको फैसलामाथि प्रश्न उठ्न थाल्छ।

देशमा खासगरी राजनीति मुछिएका मुद्दाहरूमा‍ न्यायपालिकाप्रतिको विश्वास रसातलमा पुगिसकेको छ। बालेनजीको प्रश्नलाई सो परिप्रेक्षमा हेरेर न्यायपालिकामा सुधार नगर्ने हो भने यसले कुनै विन्दुमा गम्भिर संकट निम्त्याउने छ।

जनताका प्रश्न:

१. प्रभावशाली राजनीतिकर्मीहरूले चाहे केही हप्तामैँ फैसला हुने, उनीहरूले नचाहे बर्षौँसम्म मुद्दा अलपत्र राख्ने न्यायलयको फैसला जनताले चाहिँ किन मान्ने?

२. संविधान र सर्वोच्चका नजिरहरूले 'यो, यो' विषयमा राष्ट्रपतिबाट माफी हुन सक्दैन भनेर किटान गर्दागर्दै सर्वोच्चको फैसला सरकारले नै अवज्ञा गर्न मिल्ने हो भने जनताले गर्न किन नमिल्ने?

३. भोलीपल्टै राजनीतिक सहमति गर्नका लागि देशद्रोह लगायतका मुद्दा लागेका व्यक्तिलाई अनायासै छुटाउन राजनीतिक प्रभाव स्वीकार्ने अदालतलाई हामीले चाहिँ किन सम्मान गर्नु पर्ने?

४. हत्याको अभियोग लागेको व्यक्तिलाई सर्वोच्चले पक्रिन आदेश दिँदा नपक्डिने को हो? के सर्वोच्चको निर्णय बालेनजीले मात्र मान्नु पर्ने हो?

५. फौजदारी अभियोग लागेका प्रधानमन्त्रीले देशको नेतृत्व गरिरहँदा उनी विरूद्धका मुद्दाचाहिँ अघि नबढाउने अदालतको निर्णय मान्नु पर्ने आधार के छ?

देश पूर्णत: असफल राज्य (Failed State) हुन अन्य विविध कारणहरूका अलावा न्यायलय र सेनाको संस्था विफल हुनु पर्छ।

नेपालमा राजनीति गाँसिएका विषयमा न्यायलय बारम्बार विफल साबित भइसकेको छ। अब सेनालाई पनि यसैगरी गन्धा राजनीतिले गाँज्ने हो भने देश असफल राज्यको संघारमैँ पुग्नेछ।
