The Ministry of Information and Broadcasting has finally made it clear it aims to regulate OTT providers just like it has regulated Cable and Television. A historic opportunity at liberalisation is being squandered and a paternalistic mechanism of censorship and government control has been proposed under the Broadcasting Services (Regulation) Bill, 2023.

What's worse? The law will also provide statutory powers of the Government over any online creator (or any, news media platform) who engages in the creation of any news or current affairs. They need to follow the, "programme code". What does the existing, "programme code" prohibit, well its a long list but it begins with, "Offends against good taste or decency".

Who will decide what is in "good taste"? Ultimately a government appointed body. Given the wide breadth of people/content who every second create something that is a comment on news or current affairs and do so regularly (when when contrasted against limited state capacity) it does not take a renaissance painter to imagine how it will be applied. Enforcement will most likely be pick and choose and yes based on, "good taste".
