Got a little sidetracked by the House voting drama after I left the courthouse earlier, so I didn’t get a chance to update you all on the first day of the @rstormsf trial.
I’ll have more in my newsletter tomorrow morning, but here are some highlights:
📌I’ve never seen a jury selection process before but it was surprisingly interesting! We got a glimpse into the lives of about 40 everyday New Yorkers: their professions, hobbies, family lives, preferred news sources, whether they watch Law & Order or CSI, what social media platforms they use, and which clubs or organizations they belong to.
📌The 12 jurors who made it through the selection process include 7 women and 5 men from a range of educational backgrounds. Notably, half are under the age of 31, which some believe could work in Storm’s favor, given that younger jurors may have more familiarity with software, crypto and blockchain tech. There are also four alternate or “reserve” jurors.
📌The DOJ’s opening argument leaned heavily on what I’m calling the “washing machine analogy.” Assistant U.S. Attorney Kevin Mosley described Tornado Cash as a “giant washing machine for dirty money” with Storm and his co-founders (called co-conspirators by Mosley) portrayed as the ones operating and profiting from it. Mosley extended the metaphor to Storm “running the laundromat,” with keys to the front door and paying for the gas and electric bills. He said Storm profited from operating Tornado Cash as a business and later “cashed out” using another account to cover his tracks.
📌But here’s what I’m hearing from a source close to the defense: While the government has charged Storm with conspiracy, the prosecutor’s opening statement didn’t actually claim he knowingly helped bad actors, or even had any contact with them. Instead, it focused on what Storm didn’t do (like not intervening or “turning off the switch”), which the defense says points more to negligence, not criminal conspiracy.
📌One eyebrow-raising moment: The DOJ said it plans to call actual hackers who used Tornado Cash as witnesses — to show the jury “how easy” it was to exploit. Kinda ironic? 🤷🏼♀️
📌While the government stuck to “big picture” metaphors and analogies, the defense got into the weeds. Their opening used visual exhibits to walk the jury through exactly how Tornado Cash worked — from how ETH transactions are processed, to what nodes do, and how funds can be traced on Etherscan. Their core argument: Storm didn’t conspire with criminals — he built a legitimate tool that was later exploited.
📌The first government witness is a woman who was scammed out of ~$200K in a shady WhatsApp trading scheme in 2021. It’s unclear so far how this ties back to Storm directly — but we pick up again tomorrow.
