​Most people watch these body camera encounters and see an officer losing their temper when their egos get crushed. What they miss is the sinister legal machine waiting just behind the scenes to crush the citizen long after the cameras shut off.

​Meet Anselmo "Enrique" Morales-Torres. He stood on a public sidewalk in Cranston, Rhode Island, recording the exterior of a National Guard military installation. Filming public buildings and government facilities from a traditional public forum is indisputably protected under the First Amendment. It violates zero laws.

Yet, within minutes, an officer confronted him, demanding his personal identification with zero reasonable articulable suspicion of an actual crime.

​When Anselmo lawfully held his ground, the officer escalated instantly from zero to one hundred, putting hands on him, unlawfully searching his pockets, pushing him against a hot patrol vehicle hood, and throwing him in a cage. Through their lack of knowledge of the law those officers slapped him with the classic contempt-of-cop charges: "obstruction of justice" and "disorderly conduct."

​The truth? The police were the ones who violated the law. Under Rhode Island statute and established Fourth Amendment precedent, passive refusal to hand over ID during a consensual encounter is not a crime.

Anselmo knew he was innocent, so when prosecutors tried to offer him a standard "no-filing" deal, essentially a one-year stay-out-of-trouble pass that avoided an outright admission of guilt, he refused to take the easy way out. He wanted his day in court. He wanted accountability on those officers.

​That’s when the prosecution and the courts turned the screws.
​As Anselmo continued exercising his constitutional rights in other jurisdictions, he faced retaliatory arrests that triggered a bail violation hearing. The court revoked his bond and remanded him into custody at the Adult Correctional Institutions (ACI)—holding him I DEFINITELY with no release date.

​Put yourself in his shoes: You have committed no violent act. You have hurt nobody. You have four young daughters at home who rely on you for food, shelter, and security. The system resets and delays your court hearings month after month while you sit behind bars. The prosecutor’s office held all the leverage: remain locked in a cage indefinitely while your family suffers and falls into financial ruin, or plead guilty to trumped-up charges and walk out the door today.

​He did what any loving father had to do to get home to his children—he signed a guilty plea for probation and 100 hours of community service.

​Here is the real corruption: under the federal doctrine of Heck v. Humphrey (1994), if you have a valid criminal conviction on the record, you are legally barred from filing a federal Section 1983 civil rights lawsuit against the officers for unlawful arrest if winning that suit would invalidate your conviction.

​By using pre-trial bail revocation to force a guilty plea out of an innocent man, the prosecutors achieved the ultimate departmental cover-up:
​They wiped away any chance for Anselmo to sue the arresting officers for civil rights violations.

​They shielded the city and its insurers from paying for unlawful detention and excessive force.
​They protected the officer from facing a federal judge or public civil liability, ensuring zero real reform happens inside that department.

​This is why First Amendment auditors do what they do. They put their physical bodies, their clean records, and their freedom on the line to expose a corrupt pipeline where law enforcement violates basic constitutional rights with impunity, and prosecutors use pre-trial incarceration as a weapon of extortion to bury their misconduct.

​When accountability is made impossible by design, shining a spotlight on the process is the only weapon the public has LEFT.

Sgt. Michael Casey of the Barberton, Ohio Police Department stopped Vincent White at a bus stop after work. White was in a high-visibility vest. Casey said the clothing made him look like a solicitor and he was investigating possible soliciting. No call is mentioned in the video.

White said he was waiting for the bus and refused to ID. Casey told him he was not free to go, patted him down, and put him in the back of the cruiser. White missed his bus.

When White said, “you’re about to go viral,” Casey replied, “Well, then we’ll go viral.”
