@JGBaker1806 Congratulations. Well deserved. But if I read the fine print on the award correctly, I can’t agree “fairness and procedural due process” have been “safeguarded.” Twenty years has demonstrated that is impossible in the fundamentally illegal, corrupt and rigged commissions system.

@steve_vladeck@tribelaw Thanks for the info. I worked on the extraordinary writ challenging Army jurisdiction over Sands in the late 80s/early 90s while at Army Defense Appellate. We lost the jurisdictional issue, but he was acquitted at court-martial at Ft. Stewart.
@marontheweb@tribelaw It certainly has a chilling effect. Article 88 criminalizes “contemptuous words” against the President and certain other government officials. 133 and 134 are the “General Articles” that can be tailored to make “new” crimes. Lots of prosecutorial discretion, and thus risks.
@tribelaw The second are the provisions of the UCMJ (Article 2–Jurisdiction, and Articles 88, 133 and 134) that can expose military retirees to court-martial jurisdiction exposure for criticizing the President. Under the current DOD and DOJ regimes, these are legitimate fears.
@tribelaw In case you are not intimately familiar with military law, two areas help provide important context to veterans’, and particularly military retirees’,reactions to the current President. The first is the historic concept of “divestiture” and the role it has played in the military
@tribelaw Professor Tribe, I’ve been a fan of yours since law school (UGA law ‘87) and enjoy following your tweets. I’ve been a practicing attorney for 33 years—retired after 20 years active duty as an Army JAG and then 10 years as a senior civilian attorney in the federal government.

@GunsonWildlife happy holidays! I just read this review. Have you read the book? Have you heard of the author? Her background in African wildlife made me think of you.
