As an active Scouting leader it's important for me to address the comments under this amazing display of civic service by Troop 36.
First of all, they are doing nothing wrong. The US Flag Code is the only guidance that matters. Everything else is either tradition or opinion. Comments like these are exactly why Scout units do not want to do these ceremonies; because people who know nothing, but are strongly confident in their ignorance, come charging in to berate them.
Which brings me to point 2: why do so many people feel like they need to try and beat down these kids who are taking time from their weekend to perform a critical civic duty? Does it really make you feel stronger to ignorantly yell at children? Are you doing it because you feel like you need more attention than they do?
Third... Are you volunteering? Are you performing these ceremonies at your VFW or other veterans group? Or are you just yelling from the sidelines like so many love to do. Feel free to volunteer yourself, it's cheap and easy to do so. You have a chance to improve the experience for both yourself and others. Are you even interested in that? Or are you only interested in using the Flag as a means to attack people and groups you don't like?
Great job Scouts. Everyone else can sit down and shut up.
@MarcWatkinsEsq@NikeAnde The defendant. They elect judge or jury sentencing before trial, with a default to judge sentencing if they don’t elect. They also can’t change their election mid-trial without the State’s consent.
@MarcWatkinsEsq@NikeAnde Should mention that judge sentencing typically *does* get a sentencing hearing scheduled later, to allow time for PSI to be done. It’s jury sentencing that happens immediately.
@MarcWatkinsEsq@NikeAnde This one was on the faster side, but still not out of the ordinary. I’ve had some that lasted barely a day and a half.
Same day sentencing also not unusual. My judge expects everyone to have punishment witnesses lined up while the jury is deliberating guilt/innocence.
BREAKING: Karmelo Anthony has been sentenced to 35 years in prison for the stabbing death of Austin Metcalf in 2025 after the same jury found him guilty of murder earlier today.
They rejected the sudden passion claim.
@HRH_SHP They raised it during punishment because it’s a punishment phase issue. The statute explicitly makes it a punishment issue rather than one for guilt/innocence.
@Michie211344312@MaryAnnreports In Texas, defendants must choose whether the judge or jury will sentence if convicted. Jury sentencing is pretty typical.
@JTAlexander Should also point out that failure to submit a jury instruction on a requested lesser included is a common source of reversals on appeal. Jury charge error is one of the fastest ways to have a righteous conviction overturned.
@AkimboRambos@jdmiles11 Wouldn’t be surprised if both sides are done and they’ve been working on jury charge so they can rest/close, charge, and argue after break without having jury go in and out repeatedly.
