I completely disagree with your statement. Here’s why:

FTX should not be allowed to designate claims in a “Potentially Restricted Foreign Jurisdiction” as “Disputed Claims.” This constitutes an impermissible and material modification of the Plan. The Plan already defines what qualifies as a “Disputed Claim,” and this new designation significantly alters how these claims are treated. More importantly, creditors voted based on the existing definition of “Disputed Claims,” so changing it now fundamentally undermines the basis of that vote.

FTX Recovery Trust must demonstrate that it applied a consistent and uniform standard when deciding whether to designate a jurisdiction as “Potentially Restricted.” However, the Motion fails to adequately explain how the list of Potentially Restricted Foreign Jurisdictions was compiled, or how the Trust has “confirmed” that it may legally make distributions in the non-restricted jurisdictions (see Paragraph 2 of the Motion). The lack of transparency and consistency in this process raises serious procedural concerns.
