@TheMightyForego@Jim_Rothman If Jury believes fractionated: ABUS wins
-fractionated shows infringement
If Jury believes non-fractionated (aggregate method) MRNA wins.
-aggregate does not show infringement
@TheMightyForego@Jim_Rothman Jack if I read this correctly, Judge believes there is a material question of fact, which only a jury can decide, as to whether the fractionated value/testing is to be believed (ABUS wants) vs. whether the aggregate/non-fractionated test method (MRNA wants) is believable
@SquawkCNBC@ScottGottliebMD White House must stop the MASSIVE cutbacks on research funding that have a seismic chilling effect on cures for disease, the Director of NIH was able to hear on Jan 6, 2026 at the Pennsylvania Biotechnology Center #PABC. Great work @BeckyQuick
@yasiejko@moderna_tx@ArbutusBio@Genevantsci This litigation could be shorter than most people expect, as litigation has already concluded on the merits on 2 separate stages btw ABUS and MRNA (collateral estoppel); Can't relitigate an issue that has already been adjudicated. MRNA has exhausted all those avenues now.
