On the Eve of Dr. Fauci’s Scheduled Testimony Wednesday @SenRandPaul Erdman details “bureaucratic guerrilla warfare” to hide the facts, what he calls the “Globalist” mentality inside the intelligence community, push back against @realDonaldTrump’s agenda, reveals potential financial conflicts of interest surrounding Dr. Anthony Fauci and gain-of-function research and why he believes the Havana Syndrome cover-up was bigger than COVID.

CIA Director of Public Affairs Liz Lyons provided this statement:

“There is no disputing CIA’s record of successfully executing on President Trump’s transparency initiatives. Any insinuation that CIA was an obstacle and not a facilitator is wrong—the DIG was temporary and disbanded at the direction of the DNI herself after less than a year.”

Former DNI Gabbard did not immediately respond, nor did the Office of the Director of National Intelligence.

Dr. Anthony Fauci and Peter Daszak did not return emails seeking comment.

From the American Bar Association: "A  U.S. president has broad powers to issue pardons to individuals involved in criminal investigations. But are those powers unlimited? No, there are some limitations such as for offenses on a state level."

FAUCI PARDON: NOT BULLETPROOF

On the Pardon: Before the hearing @SenRandPaul a former senior Justice Department prosecutor told me there are three, viable legal strategies to challenge the preemptive Biden pardon.

But there is no easy path.

One strategy calls for charging Fauci with a crime, with the expectation he would file a motion with the court to dismiss based on the pardon. This could open the door to challenging the sweeping pardon’s viability and years of litigation.

Another strategy involves Congress. Because Fauci has theoretically been preemptively pardoned against past and future criminal charges related to his NIH work, it can be argued that Fauci has no plausible claim to the 5th Amendment, the right against self-incrimination.

If Fauci takes the Fifth at Senator Paul’s hearing (which he has) the committee could seek to compel Fauci's testimony. A finding of contempt could follow.

Finally, one of Fauci’s closest associates has been criminally charged. With pressure and the right incentives he might be flipped and become a cooperating witness.

Dr. David Morens, who was a senior advisor to Fauci at the National Institute of Allergy and Infectious Diseases, was indicted on multiple charges including conspiracy and obstruction, including destruction, alteration or falsification of federal records.

Along with allegations that personal email accounts were used to evade the Freedom of Information Act, this could be a powerful motivator.

From media reports: Dr. David Morens has pleaded not guilty to all five federal criminal counts.

NOTE: @SenRickScott has just raised the Morens case. Fauci continues to take the Fifth.

BIDEN GHOSTWRITER: ERASED AUDIO TAPES

A key data point is being lost in the conversation.

According to Special Counsel Hur, the ghostwriter erased the Biden tapes after he learned of Hur's investigation.

Hur considered charging the ghostwriter with obstruction but declined, in part because the ghostwriter admitted to his actions, kept the Biden transcripts, and the FBI recovered the recordings from his computer.

NOTE: The Biden audio tapes were recorded SEVEN YEARS BEFORE Hur concluded Biden could not be prosecuted for mishandling classified information because of his age, and failed memory.
