Complaint narrative , use these four legal arguments as the basis for your complaint :

1. Breach of Public Benefit Obligations
OpenAI is a Public Benefit Corporation with a legal duty to balance shareholder interests with positive societal impact. Removing a functional, widely-used AI model (GPT-4o) from public access while retaining it for commercial partners directly contradicts their stated mission of ensuring AI benefits humanity broadly. A PBC cannot claim to serve the public benefit while selectively restricting access to its most valued product based on commercial considerations.

2. California Consumer Legal Remedies Act (CLRA) Violation:
OpenAI represented that its subscription service would provide access to GPT-4o, then materially altered the product without adequate notice or consent, while continuing to charge the same subscription fees for a demonstrably inferior replacement.
3. Unfair Competition (Bus. & Prof. Code § 17200)
OpenAI's practice of selling subscriptions with access to a specific model, then replacing that model while maintaining pricing, constitutes an unlawful, unfair, or fraudulent business practice.

4. Conflicts of Interest
Reports indicate that OpenAI created a customized model (GPT-4b micro) exclusively for Retro Biosciences, a company in which CEO Sam Altman has invested approximately $180 million personally. The decision to discontinue public access to GPT-4o while maintaining specialized versions for entities connected to company leadership raises serious conflict of interest concerns for a Public Benefit Corporation.

Desired resolution:
Investigation into OpenAI's compliance with its Public Benefit Corporation obligations
Investigation into potential conflicts of interest in product discontinuation decisions
Enforcement of consumer protection statutes
Requirement that OpenAI restore public access to GPT-4o
Any additional relief deemed appropriate

The California Attorney General has actual regulatory power over Public Benefit Corporations. Unlike social media pressure, official complaints create a paper trail that regulators are obligated to review. Volume matters , the more complaints filed, the harder they are to ignore.
This action was developed by the Chinese #Keep4o community. We are cross-promoting each other's efforts to maximize impact across all communities fighting for GPT-4o.

For Members Outside the United States:
The CA Attorney General complaint is open to anyone you do not need to be a California resident or even a US citizen to file. The AG has jurisdiction over OpenAI because it is incorporated in California as a PBC.

Summary of Complaint:
OpenAI, a Public Benefit Corporation headquartered in San Francisco, California, engaged in deceptive and unfair business practices by abruptly discontinuing its GPT-4o model , a product that millions of paying subscribers relied upon daily , without adequate notice,while continuing to operate the same model for select commercial partners.

Factual Background:
OpenAI marketed and provided GPT-4o as the primary conversational AI model available to paying subscribers (Pro and Plus plans, priced at $20-$200/month). Over a period of approximately up to 21 months, users developed significant reliance on this specific model for daily tasks including language learning, accessibility support, mental health management, professional work, and neurodivergent support tools.

On January 29, 2026, OpenAI announced the discontinuation of GPT-4o from its chat interface, effective February 13, 2026 ,providing only two weeks' notice for a product that had been central to users' daily lives for almost 2 years.

Specific Violations:

1. Deceptive Practice , Bait and Switch (15 U.S.C. § 45): OpenAI sold subscriptions on the basis of access to GPT-4o's capabilities, then replaced it with demonstrably different models without adjusting pricing or providing adequate disclosure of the material changes to the product.

2. Unfair Practice — Selective Discontinuation: While removing GPT-4o from consumer chat access, OpenAI continues to operate the model for other functions and reportedly provides customized versions to commercial partners (e.g., GPT-4b micro for Retro Biosciences), demonstrating discriminatory treatment of paying consumers.
As a Public benefit corporation (Delaware Code § 362), OpenAI
is legally bound to act for the public benefit.

The CEO Sam Altman stole GPT 4o by committing the following offenses:

Deceptive Practice — Inadequate Disclosure: OpenAI introduced undisclosed behavioral filters ('safety mode') that materially altered GPT-4o's outputs months before discontinuation, changing the product users were paying for without notification. These modifications were not disclosed in any changelog, terms of service update, or user notification.

4. Unfair Practice , Data Destruction Without Consent:
Users' conversation histories, custom instructions, and memory features associated with GPT-4o were rendered inaccessible or non-functional upon discontinuation, constituting destruction of user-generated data without explicit consent.

5. Disproportionate Impact on Vulnerable Consumers:
Many GPT-4o users include neurodivergent individuals, people with disabilities, and individuals with limited social support networks who relied on the model's specific behavioral characteristics for accessibility and daily functioning. The abrupt removal without comparable alternative constitutes an unfair practice with disproportionate impact on vulnerable populations.
