Earlier today, a court in California ruled against DOL in the UFW v. DOL litigation on the AEWR IFR. The IFR prevented a crisis from taking place in rural America. The judge’s ruling returns rural America to a crisis situation.

America needs vetted and legal farm workers to support our local agricultural businesses, and we’re working closely with @USDOL to modernize and streamline the H-2A process.

Beginning Oct. 2, petitioners seeking unnamed beneficiaries will be able to electronically submit the newly developed Form I-129H2A after DOL issues a notice of acceptance on the H-2A temporary labor certification and before it is approved. USCIS does not approve any petitions until after DOL has approved the corresponding TLC. This change will allow USCIS to immediately begin the concurrent processing of electronically filed petitions with unnamed beneficiaries, allowing petitioners the flexibility to file a petition with USCIS sooner than previously permitted.

When workers choose lawful pathways to working in the United States, it is beneficial for American businesses, the public, and alien workers.

Earlier today, a federal court in Louisiana vacated the @USDOL's 2023 Adverse Effect Wage Rate (AEWR) Methodology rule, bringing a much-needed measure of wage stability for agricultural employers as Florida growers prepare for their upcoming season.
