@NSDev3 @nsitharamanoffc @nsitharaman Customs Act have its own Quasi Judicial officers with powers of civil court. It is a unique act with synthesis of CrPC and CPC. Which makes delineation of offences into cognizable and non cognizable difficult to fit into definition provided in the CrPC.

@NSDev3 @nsitharamanoffc @nsitharaman As per CrPC cognizable offences are those offence where arrest can be made without warrant. Whereas in non cognizable offences arrest can be made only after sanction by a magistrate. As per custom act each arrest needs to be sanctioned by commissioner. So why this bifurcation?

@nsitharamanoffc @nsitharaman Section 81(b) of Customs Act provides for regulation on the custody, examination, assessment to duty and clearance of baggage. However it appears no regulations have been issued in this regard leaving gaps in enforcement.

@nsitharamanoffc @nsitharaman There is no provision for investigation in the Customs Act. However search, seizure, arrest are all part of investigation as per CrPC. Hence Specific provision may be made for appointment of Investigation officer under Customs Act. 2/2

Similar course should be conducted for Cochin Customs Havaldars also. Apart from this, there should be periodical fire arms training for other executive cadres also.

NACIN Mumbai successfully conducted a 2 week course for Hawaldars of Customs from 11 to 22 November 2019, on Security Management and Arms Training.

On 16.11.2019 2 pax arrived from Kochi by SG608 were intercepted at The Domestic Terminal. On personal search 21, 10 tola #Gold Bars weighing 2446.5 gms totally valued at Rs.83 lakhs were recovered in her small handbag. Both Passengers arrested. @cbic_india

We strongly condemn the recent incident of violence against the police personnel on duty at Tis Hazari Court, New Delhi. We stand shoulder to shoulder with our colleagues in these testing times and urge the concerned that the culprits be brought to justice at the earliest.
