I think the Somaliland government is now humiliating itself. What does the fact that the Somaliland Ministry of Labour, Social Affairs & Family @slmolsaf is stating (below) it had “documented concerns relating to the alleged abuse and exploitation of young girls” against me mean, after very similar allegations had been made by @NimkoAli three years ago, and she could not back them up in a British court?
Nimko's allegations had been made on 28 March 2023, in the context of the war over Lasanod, in which Somaliland forces attacked a town in northern Somalia and likely committed war crimes as documented by Amnesty International and MSF.
Now, in my view, the fresh statements by the
@slmolsaf mean that this Somaliland ministry has no understanding of due legal process.
@NimkoAli ‘s allegations have been dealt with in a proper legal way in the UK (Case Number KB-2024-000862). I filed a case against her in early 2024. She had to react. She did so by reiterating her claims, which is called a “truth defence” in British law. This means: she needs to back up what she stated with hard facts (alternatively, she could have apologised right away and gotten the matter out of the way, without investing much money).
Subsequently she had two full years to provide evidence that could be presented before a court in London. She had experienced and really expensive lawyers at her side. She travelled to Somaliland in mid-2024 to collect whatever she could find backing her claims up. I know from my own contacts in Hargeysa that she spoke with current and former leading government officials including former Minister of Interior, Ismael Yere, who was in charge when I was deported for political reasons end of 2004 – because I had ventured into the “unsettled” eastern territories, especially Buuhoodle, as young PhD student. Back then Ismael Yere shouted at me in his office and said: “not even I could go there!". Yeah, exactly! So, this is why I was deported. I wrote about it in my PhD-thesis published online 2013. Later, from 2008 onward, I returned to Somaliland again multiple times officially welcomed by the authorities and cooperating with, back then, reputable institutions like the Academy for Peace and Development in Hargeysa under the chairmanship of Prof. Mohamed Said Gees and Boobe Yusuf Du’aale, two experienced intellectuals; they read and commented on my academic output.
Now, back to the case against Nimko: The result of all her evidence collection endeavours until early 2026 was that @NimkoAli could NOT bring the evidence that convinced her and especially her lawyers and those (partly right-wing populist) financial backers she had in the UK that she could really win the case. This, and only this, was the reason why during an official mediation demanded by the court in advance of the hearings (planned for November 2026) @NimkoAli had to agree to a quite humiliating agreement.
This agreement entailed various provisions, the most important of which were: 1) a full and unreserved apology (which she published on 29 June 2026), 2) paying substantial compensation to me personally which I will be receiving soon, 3) the guarantee of non-repetition of the allegation; 4) a reading of the agreement in open court in London which means that the settlement is on public record, which will happen very soon; and a few other procedural provisions.
This is due legal process. It entails very high standards for the disclosure of evidence. I had to live up to them (in my defence against her allegations); she had to live up to them (in her underpinning of her allegations). I looked into her eyes during the mediation; I met her lawyers; I saw how they tried to bully me; I stood my ground, backed by my lawyers; I had tons of evidence ready to be disclosed which proved that I was not even in those places where, according to @NimkoAli , I had done something wrong. Nimko had to specify where and when the abuse allegedly happened, which was in Hargeysa end of 2003 and early 2004. But I was, during that time, in Lasanod, Garowe, Buuhoodle and even in Nairobi for some time. For all that I had witnesses who were ready to testify. And all that was documented in field notes, itineraries, and photographs clearly dated and stored among other places with my old research institute in Germany (where the data lay on an institute’s server since 2005, untouched).
So, evidence is really important, as are standards of proof. These issues have to be taken seriously, if you believe that due legal process has any meaning. Now, the @slmolsaf as a government institution seems to have no clue about such things. It thinks that it simply can state something on behalf of the Somaliland government that falls way short of real legal standards. This is humiliating for the Somaliland government. If I were the Ministry of Foreign Affairs @somalilandmfa or the Presidency of Somaliland @Presidencysl_ or the President @Abdirahmanirro , I would be really worried about this show of incompetence.
