El caso United States v. Heppner deja una lección incómoda pero urgente: hablar con una plataforma pública de IA sobre estrategia legal, hechos sensibles o líneas de defensa puede salir carísimo. Un juez federal dejó claro que la IA no es tu abogado y que, si compartes ahí información delicada, no puedes dar por hecho que está protegida por el secreto profesional.
Lo verdaderamente serio no es la tecnología en sí, sino la falsa sensación de intimidad que produce. Mucha gente cree que escribirle a una IA es como pensar en voz alta dentro de un cuarto cerrado. No. En términos jurídicos, puede significar que abriste la puerta a un tercero, rompiste la confidencialidad y convertiste en descubrible algo que jamás debió salir de una conversación reservada con tu defensa.
La advertencia es brutal para litigantes, empresas y clientes: la comodidad digital no sustituye al secreto profesional. Si hay estrategia, riesgo penal, información sensible o defensa jurídica de por medio, no se improvisa con una herramienta pública.
