@EricCrampton I think it's also worth emphasising a subtle point: any decision will apply to *this particular brand of large marshmallows*. In each case you have to look at the "basket of evidence": how the product is designed, marketed, consumed, etc.

I keep tabs on UK VAT cases as I used to work in that area, and this is your regular reminder that we shouldn't mess with GST in NZ or we'll get serious court decisions about whether large marshmallows are confectionary or not.

Update: this case has gone to the Court of Appeal. There will now be a fourth hearing on this matter to decide whether these large marshmallows are "normally eaten with the fingers". @EricCrampton
