NEWS: X sued New York over a hate speech law and lost
In December 2024 New York passed the Stop Hiding Hate Act.
It applies to social media companies making $100M or more a year. Twice a year they file a report with the state attorney general explaining how they handle hate speech, extremism, harassment, foreign interference and disinformation.
The law does not tell them to remove anything. Only to explain their own rules and report the numbers.
Ignore it and the fine runs up to $15,000 per violation per day.
It was written by Brad Hoylman-Sigal and Grace Lee with help from the Anti-Defamation League. Their letter said Musk and X had a "disturbing record" on moderation "that threatens the foundations of our democracy."
X sued on 17 June 2025 in Manhattan federal court and named attorney general Letitia James.
X argued the law forces it to talk about "highly sensitive and controversial speech" the state dislikes. "This is not a role that the government may play."
X had real reason to expect a win.
It ran this same play against California's nearly identical AB 587 and it worked. On 4 September 2024 the Ninth Circuit blocked the core reporting parts of that law.
California settled in February and agreed not to enforce them.
New York went the other way.
On 26 August Judge John Cronan, a Trump appointee, threw the case out with prejudice. X cannot rewrite it and try again in his court.
His reasoning was that the law asks for facts, not opinions.
"Burger King chooses to generally offer higher-calorie items than, say, Sweetgreen, but the disclosure of calorie information remains purely factual. So too here."
He also rejected X's separate claim that Section 230 blocks the law.
Neither X nor the attorney general's office would comment. No appeal has been reported yet.
The same argument wins in California and loses in New York. That is why the next move matters.
