An employee does not have to prove their innocence to establish unfair termination
The Court of Appeal has held that once an employee establishes termination, the employer bears the statutory burden of proving the reason for termination and justifying its validity and fairness.

The animals reportedly belonged to Israelis and were poisoned in an attempt to frame Palestinians for killing them.
Congratulatory Note On the Launch of Africa Credit Rating Agency
On behalf of the Government and people of the Republic of Kenya, and on my own behalf, I convey our warmest congratulations to the African Union on the historic launch of the Africa Credit Rating Agency (AfCRA) in Port Louis, Republic of Mauritius.
As the African Union Champion for Institutional Reform, I regard this achievement as a powerful expression of our shared determination to build an AU that is strong, effective and fit for purpose, and to advance Agenda 2063 through institutions that translate continental ambition into tangible results.
I also commend the African Peer Review Mechanism and its partners for their leadership in bringing this important reform initiative to fruition.
I have consistently championed the reform of the global financial architecture, fair and credible assessment of African risk, and the establishment of AfCRA as an African-led institution capable of reflecting the continent’s true economic realities and potential.
Its launch affirms a wider continental aspiration: Africa must shape its own narrative, strengthen its financial sovereignty and mobilise capital for development on fairer terms. This achievement now calls for collective political ownership.
African leaders must place their full weight behind AfCRA’s success while safeguarding its independence, professionalism and methodological integrity.
In this spirit, Kenya is pleased to welcome AfCRA and to commence discussions on Nairobi serving as a secondary jurisdiction for the agency, as well as on Kenya becoming a sovereign client of this important continental institution.
Through this commitment, Kenya seeks to demonstrate the practical leadership, confidence and solidarity required to transform Africa’s collective aspirations into durable institutions.
At a moment when global markets are being reshaped by geopolitical competition, volatile capital flows, the energy transition and artificial intelligence, Africa must have trusted institutions capable of interpreting these shifts through the prism of its own realities and development priorities.
AfCRA is thus more than a new institution; it is a strategic instrument for strengthening investor confidence, widening Africa’s policy space and ensuring that the continent participates in the emerging global financial order with greater agency, unity and influence.

The death penalty is inadmissible because it is an attack on the inviolability and dignity of the person. The common good can be safeguarded and the requirements of justice can be met without recourse to capital punishment: effective systems of detention have been developed that protect citizens while at the same time do not completely deprive those who are guilty of the possibility of redemption. #NoDeathPenalty
Today is World Mental Health Day, a reminder that mental health matters to all of us.
The legal profession can be demanding. Heavy workloads, tight deadlines and everyday pressures can leave us stressed, overwhelmed or burnt out. Findings from the @ABAesq surveys have highlighted the mental health challenges facing lawyers, reminding us that these struggles are real and cannot be ignored.
Over time, I have learnt to cope through debriefing, family time, social media breaks and dancing! 💃🏽

The High Court's Judgement in the case against the National Fertiliser Subsidy Programme is a victory for the rule of law. In its judgment of 6 October, the High Court upheld LSK’s challenge on two critical fronts, the unlawful failure to constitute the Fertilizer and Animal Foodstuffs Board, and NCPB’s violation of farmers’ consumer rights through the sale of non-conforming fertilizer. Despite objections to the Court's Jurisdiction on grounds of concurrent criminal proceedings already being underway, the Court has affirmed that a prosecution does not discharge the State’s constitutional obligations.
The judgment draws a firm line against government by convenience. A mandatory statutory duty cannot be suspended by restructuring plans or replaced with administrative arrangements. The Court did not assume that constituting the Board would have prevented the scandal, it affirmed something more fundamental; the Executive must obey the law, including when compliance requires it to act. Inaction is not beyond constitutional scrutiny.
For farmers, the Court affirmed that rights attach to the goods they receive, not to the eventual outcome of a criminal trial. NCPB’s responsibility to supply fertilizer of reasonable quality did not depend on proving who introduced the defect or establishing criminal intent. Article 46 provides an independent constitutional safeguard. Citizens do not have to wait for a conviction before the State can be held answerable for violating their rights.
This victory establishes the wrong, the next task is to secure meaningful correction. The judgment grants neither compensation nor a deadline for constituting the Board, leaving important work unfinished. Government should fulfil the statutory duty, and farmers with outstanding losses should now pursue properly evidenced claims. The principle is now unmistakable. Public power carries public duties, and those duties are enforceable. The rule of law wins when government is reminded that compliance is an obligation.
