INDIA - The High Court of Madras has ruled that downloading and viewing child pornography - child sexual abuse materials - is not a criminal offense.

The Protection of Children from Sexual Offences Act (POCSO Act) 2012, does not criminalize the consumption of child abuse content, nor does the Information Technology Act, 2000 (IT Act), said Justice N. Anand Venkatesh.

Astonishingly, the high court justified this decision by pointing to escalating rates of pornography addiction and consumption among minors.

The court said: “Porn addiction, like other substances or ‘things’ that people can become addicted to, can be understood through principles of ‘operant conditioning’.”

It added: “This is where a certain behaviour, watching porn in this case, is ‘reinforced’’, rewarded, which in turn makes you want to do it again (and again)… Porn can be especially reinforcing because the reward taps into a very basic instinctual drive-sex.”

The court stated that due to the accessibility of sexually explicit material on the internet, porn addiction is becoming a growing concern in teenagers. It cited a study which suggests that nine out of 10 minor boys are exposed to some form of pornographic content. Whereas, six out of 10 girls are exposed to pornography.

The study notes that teenage boys between 12–17 years of age have the highest risk of developing porn addiction. On average, a male’s first exposure to pornography is at 12 years old.

However, in 2022 the Supreme Court of India refused a plea to gather data on a link between pornography consumption and sex crimes, including child abuse.

The petition, brought forward by Nalin Kohli, cited an incident in Assam where a direct link was found between pornography and sexual assault on a minor girl. To this, the bench said: “The issue of the link between viewing pornography and crime is individual case specific.”

In 2021, three boys were implicated in the killing of a six year-old girl by stoning after she refused to participate in mimicking sexual activity they had seen in pornography.

The boys had been accessing adult materials through their parents’ mobile phones while taking part in online school lessons. Two of the boys were 11 and one boy was aged eight. They were sent to a juvenile correctional facility in Jorhat.

According to police officer Mrinmoy Das, “Two of the boys first tried to replicate the pornographic acts they had been watching on their mobiles and tried to molest their neighbour’s girl. When she resisted and threatened to tell her parents, they hit her head with a stone and carried her to the toilet in the crusher plant where they hit her again. The third child stood guard outside the toilet.”
