Polska po raz kolejny pokazuje przedsiębiorcom, że czasem najlepszym doradcą biznesowym okazuje się… własne państwo. Aktualnie firmom z branży krypto doradza jedno: załóż spółkę za granicą.

Dlaczego?

Aby prowadzić w UE działalność w branży kryptoaktywów, konieczne jest posiadanie licencji CASP, czyli Crypto-Asset Service Provider. Problem w tym, że w Polsce takiej licencji zwyczajnie nie da się dziś uzyskać.

Powód? Polski rząd do tej pory nie uchwalił ustawy, która wskazywałaby organ odpowiedzialny za wydawanie takich zezwoleń i uruchamiała krajową procedurę licencyjną.

W praktyce oznacza to, że od 1 lipca 2026 r. polskie podmioty działające w tej branży — jeżeli nie uzyskają licencji w innym państwie UE — powinny zaprzestać świadczenia usług kryptoaktywowych na rynku unijnym. Absurd? Delikatnie mówiąc.

Najprawdopodobniej firmy, którym realnie zależało na kontynuowaniu działalności, już dawno zdążyły założyć spółki w innych państwach UE i rozpocząć proces uzyskiwania licencji za granicą. Na szczęście licencja uzyskana np. w Estonii może być następnie paszportowana na całą Unię Europejską — w tym również do Polski.

Trudno chyba wymyślić skuteczniejszy sposób na wypchnięcie z polskiego rynku ciekawych, innowacyjnych firm z dużym potencjałem.

Co ciekawe, Polska nie ma żadnego problemu z wprowadzaniem przepisów znacznie ostrzejszych, niż wymaga tego Unia Europejska — chociażby w zakresie raportowania schematów podatkowych czy AML. Gdy trzeba przedsiębiorcy dołożyć obowiązków, jesteśmy prymusem. Gdy trzeba stworzyć sensowne warunki do prowadzenia działalności — robi się problem.

Takie działania sprawiają, że przedsiębiorcy zaczynają szukać alternatyw poza granicami kraju i coraz częściej dochodzą do wniosku, że założenie spółki za granicą nie jest fanaberią, tylko racjonalną decyzją biznesową.

A później polski rząd jest zdziwiony, że ta decyzja okazuje się dla nich jednym z najlepszych ruchów w całej karierze.

Poniżej zamieszczam ranking konkurencyjności podatkowej. Na czele tabeli znajdują się państwa z najwyższą ogólną oceną systemu podatkowego — obejmującą między innymi przejrzystość, stabilność i konkurencyjność przepisów dotyczących CIT, PIT, VAT, podatku od nieruchomości, podatku u źródła, dywidend oraz podobnych obciążeń.

Od 12 lat z rzędu pierwsze miejsce zajmuje Estonia.

Ale spokojnie — jeśli odwrócimy tabelę do góry nogami, Polska też wreszcie znajdzie się w czołówce.
