Arappor’s Immediate Response to Government’s Statement of Ramsar Pallikaranai Marshland
Since media people have asked for a clarification from our side to Government’s response of Ramsar Pallikaranai marsh, we are posting a short clarification immediately. More detailed explanations will follow.
The response of the Government has only raised more questions than answers. If at all, anything, it has only confirmed our allegations even more strongly. The Government has not said that the proposed site does not come under Ramsar. Rather, they have tried saying that there is no Ramsar Pallikaranai Marshland ‘officially’ in the first place yet. It only shows that there is no political will to save the Marshlands. What is the purpose of designation of Ramsar if the Government is not interested in saving Marshland?
Firstly, I would like to point out that Ramsar lands need not be notified for its applicability to be covered under the Wetland (Conservation and Management) rules 2017. The Guidelines for implementing Wetlands (Conservation and Management) Rules, 2017 clearly say the following in Section II
The provisions of Wetlands Rules apply to:
a) Wetlands designated by the Government of India to the List of Wetlands of International
Importance under the provisions of the Convention on Wetlands (Ramsar Convention).
[Ref. Rule 3 (a) of Wetlands Rule]
b) Wetlands notified under the rules by the Central Government, State Government and UT
Administration. [Ref. Rule 3 (b) of Wetlands Rule]
The above clearly means that the rule is applicable to Ramsar sites from the date of designation which is April 8, 2022 here. Only for wetlands other than Ramsar, for which any state of central or union territory wants to make it as wetland under this rule needs to notified separately and the rule is applicable to such wetlands from such date of notification.
Secondly, this is also clear from the DIPR press release which has stated from section 66 of Guidelines that
“All Ramsar Sites, deemed covered under these Rules, shall also be notified as per the process laid out in paragraphs 57-64. This is proposed to ensure that the site boundaries are properly delineated and the knowledge about the same is available in public domain. It is adused that the information in the ‘Brief Document’ may be consistent with Ramsar Site Information Sheet (RSIS), submitted to the Ramsar Convention during site designation or RSIS updated thereafter”
The above says that all Ramsar sites, deemed covered under these rules. This means that all Ramsar sites once designated are automatically covered under the rules as explained above. The guidelines further say that they also needs to be notified as per para 57 to 64 for the purpose to ensure site boundaries are properly delineated and the knowledge of the same is available in the public domain. It must be understood that Ramsar sites needs to be notified only for this purpose and not for applicability of the rules in the first place.
Therefore, the rule, that no permanent construction can be made is applicable to the Ramsar site survey numbers from the date of designation.
Other than this, it is already clear how the Government has delayed the process of Integrated management plan by more than 3 years now. The delineation of the boundary of survey numbers that NCSCM is doing can change the actual boundary in the map by a few inches here and there, but it cannot change the Ramsar survey numbers itself. Brigade’s survey numbers and the entire 14.7 acres of land are well within Ramsar not only from the original map of State Wetland Authority but also clear from the recent map of CMDA issued in October 2025! Therefore, The Government’s effort is nothing but trying to hide an elephant in a plate of rice.
It must be understood that as per Government’s own admission only 698 hectares are with forest dept as Pallikaranai marsh. Why did the TN Government then include the rest of 550 hectares, many of them in private hands today, as part of Ramsar to make it 1247 hectares and designate it in April 2022?? It is because all these today’s private lands were also originally part of the Marsh and were given patta at various points of time illegally.
The Government must realize its wrongdoing and must immediately cancel the environment clearance and plan approval given to Brigade Morgan Heights immediately and take action against those responsible for wrongdoing.
