· What is really being solved here? Indeed the provision is not new, what we take issue with here is the prescription of a 60.0% floor, that is the elephant in the room
· The departure from an environment where the taxpayer & the Revenue Authority had the latitude to discuss & agree whether there was a case for enforcement anyway to one where the baseline start is 60.0% of a company’s undistributed income is really the issue we seek to address
· If Kenya seeks to shift to a a regime that is anchored on undistributed profits rules which include a defined minimum distribution percentage, as the proposed amendment to Sec24 of the Income Tax Act suggests, what safeguards exist against potential overreach by the Revenue Authority?
The High Court yesterday made a very important decision. When you take a loan from any lending institution, the amount of interest accrued cannot exceed the amount you received from the institution (principal). Meaning if you borrow kshs. 100,000, you cannot pay more than kshs.200,000 in total. This is good news to many Kenyans. Tag that one lending institution wajionee habari kamili.
