@JulieChangRE I believe life estates were mostly used in the past to get around probate (ex: I transfer title of the home to my kids and give myself a life estate). But now we have trusts to solve that issue.

The big issue with laws that have attorney fees provisions (ADA, FDCPA, habitability, etc.) is that it is less expensive for the defendant to settle a frivolous lawsuit than to successfully defend themselves

@realitybasedlaw@SinaiLawFirm The current minimum thresholds for garnishments and automatic exemptions for bank levies can make it tough. Success with claim of exemptions will vary by judge.
@SinaiLawFirm Yep. There is some really good case law re: the limited res judicata effect of unlawful detainers. Hong Sang Market, Inc. v. Peng (2018). It’s in regards to a commercial tenancy but still applicable.
