After 3 recent webinars with top U.S. immigration attorneys about the upcoming H-1B lottery, here are the factors companies should be thinking about:
1️⃣ This is a strong year to enter talent into the lottery.
Some estimates say up to 50%, others 10–20% — largely due to the $100K fee for talent abroad.
That could mean the highest selection rates in a decade for change-of-status cases (foreign nationals already in the U.S.).

2️⃣ The $100K fee may not last
Two active court cases could overturn the proclamation as early as March.
Many companies are still registering talent abroad so they can file if the courts rule against the fee.

3️⃣ The weighted lottery changes strategy
Companies can think more creatively about specialty occupation categories.
Some categories have lower prevailing wage bands, allowing sponsorship in higher bands without increasing salary.
