Judge says the Trump admin's arguments for labeling Anthropic a supply chain risk got "worse."
"I don't see additional evidence from the government really justifying what it did. If anything, it seems like the record, in some ways, has gotten worse for the government," U.S. District Judge Rita Lin said within the first five minutes of today's hearing.
Why it matters: This is poised to be a lengthy legal battle between the government and an AI company that's simultaneously helping shape the government's AI safety rules.

We have information that Moonshot AI distilled Anthropic’s Fable for the development of its K3 model.
To do this they developed a sophisticated internal platform to conduct large scale distillation against U.S. models, allowing them to quickly switch between multiple methods of access to avoid detection. Moonshot AI has also acquired GB300-equipped servers and has accessed GB300s in Thailand, likely to train its AI models.
The United States strongly supports the free and fair development of AI, including a thriving competitive ecosystem that spans frontier models, specialized systems, open-source frameworks, and open-weight models. Legitimate AI distillation used to create smaller, more efficient models plays a vital role in this open innovation ecosystem. However, large-scale, covert industrial distillation aimed at stealing proprietary U.S. technology and undermining American research is unacceptable.

Illinois is officially the first state to pair AI transparency requirements with independent verification, an important step toward the accountability this technology demands. After a series of productive conversations with the US government, we're redeploying the model with a new set of classifiers to target and block more cybersecurity tasks. In the near term, some routine tasks like coding and debugging will fall back to Opus 4.8. We’ll continue to refine these classifiers over the coming weeks to reduce false positives and better distinguish genuine misuse from legitimate requests.
We’ve also begun drafting a consensus framework—with Amazon, Microsoft, Google, and other Glasswing partners—for assessing the severity of AI jailbreaks and how AI developers should respond to them. We invite other industry partners and model providers to join us in this effort.
Finally, we’re scaling up our collaboration with the US government on model testing and safeguards. This will include pre-release access to models and safeguards for evaluation, information sharing on jailbreaks and misuse, and dedicated resources for joint research.
