If I were a more untrusting individual I’d suggest this delay intentional.

Durham Regional Police officer Jack Stelwagen was convicted of sexual assault and sentenced to 12 months in jail.

That conviction wasn’t overturned because an appeal court found him innocent, it was quashed because the justice system violated his Charter right to be tried within a reasonable time.

According to court findings, much of the delay was attributed to the unavailability of per diem Judge Bruce Frazer, including an extended winter vacation.

The result?

A sexual assault conviction was erased because of delays within the court system itself.

Whatever your view of the case, this should concern everyone. Victims deserve timely justice, accused persons are entitled to their constitutional rights, and the public deserves a justice system that doesn’t fail both because of preventable delays.
