AFFIDAVIT OF YASIN MALIK
I have read the entire 85 pages of Yasin’s affidavit. Two things are clear:-
This affidavit is not about the person of Yasin Malik.
This affidavit is not about clemency.
This affidavit is about sanctity of the institution of dialogue and threats to its sanctity.
This is a first person account of a Kashmiri who has hundreds of cases slapped against him and has been convicted for life and the prosecution is seeking death penalty
It is based on real life events.
Please do not pass it off as yet another affidavit. It is in essence an academic analysis of the powerfulness or the powerlessness of the institution of dialogue to resolve conflicts. It symbolises the relevance or the irrelevance of the institution of dialogue specifically in the context of this region.
It addresses variables like truthfulness, trust, politics of promises and the politics of reneging on those promises. These variables maybe invisible and pushed to the sidelines, but they are important if the institution of dialogue is to have sanctity and deliverability in the future.
As per the affidavit, Yasin it seems all along believed that his engagement with Delhi was a part of a semi formal dialogue process. While Yasin believed he was taking part in dialogue process, he now retrospectively feels that Delhi was using dialogue as a ploy to practice statecraft albeit negatively.
Students of politics, academics and most importantly aspiring peace makers need to delve deep into this rare document. This comes from a person who has seen it all and shares his experiences. Academically it is a rarity. It illustrates how abandoned dialogue processes stigmatise the institution of dialogue. Equally important is the lesson that dialogue processes should not be totally shrouded in anonymity.
This world will never be free of rebels or rebellions. There will be conflicts. The means to resolve a conflict are broadly two. It is either violent means or non violent means. If a state is seen as using dialogue to not resolve a conflict, but to slander and tarnish the opponent it means it is inadvertently encouraging violent means of conflict resolution. I am just giving an academic perspective. The loss of space in a proposed dialogue process is ceded to violence.
The onus to explain whether Delhi believes in the institution of dialogue or not, is on Delhi. And in the context of the affidavit it is deeds which would matter more than words. Ironically the pattern of engagement and reneging on promises has been the same across party lines. On the use of dialogue as a tool of deception, all political parties and all bureaucratic institutions seem to perfectly overlap.
Either the actors and institutions named in the affidavit, deny what has been said in the affidavit.
OR they accept that they did not believe in engagement when they were in a state of engagement with Yasin. And the engagement was a farce.
OR
they take decisions pertaining to Yasin in the spirit of dialogue and engagement as promised to him.
Such an outcome would accord sanctity to the institution of dialogue and be a reference point for future peace makers for resolution of conflicts.
The present political and bureaucratic establishments will not rule for all times to come. Evolution will take place. Newer actors will be in power. And even newer mindsets. Maybe at a future date a certain set of rulers would want reconciliation and dialogue. What you do with Yasin today will be an asset or a liability for the rulers of the future. Participants in a dialogue with Indian state would look at the empirical evidence of how state has conducted dialogue in the past. Dialogues held in the past will be indicator of how truthful and trustworthy the state is.
There are attempts being made to tactfully denigrate this work by trying to pass the affidavit off as something which it is not. Yasin had decided to not contest the case.Which is totally different from pleading guilty

Without arguing , I can only say that stop pointing out others without an exact reason !
PDP-BJP was surely for 3 years but what made them so excited to attack him for decades of their rule !

Facing financial hardship, I was offered monetary support by Lone Sahab, who also promised “all possible help, including money” if I chose to start my own newspaper. He spoke with empathy and warmth, like a compassionate and caring father figure
I thanked him, expressing my faith that Allah (swt) would guide me through. My optimism was not misplaced.

While claiming that the bogey of rigging in the Assembly elections of 1987 in Kashmir was generated by those who didn't secure even 3% of the vote against NC's 30%+, senior @JKNC_ leader and three-time Minister Choudhary Mohammad Ramzan says that the losers got a number of his party's winners eliminated with the Pakistani gun in just three years in 1990. Even some of the NC candidates who won in the Assembly elections of 1996-- including Ministers Ghulam Hassan Bhat and Mushtaq Ahmad Lone and MLA of Langate Abdul Ahad Kar, were selectively targeted and got eliminated by their political rivals with the Pakistani gun. He claims that 3,000 of his party workers were either shot dead or killed in grenade or IED blasts out of political rivalry and vendetta. "We were selectively hounded, persecuted and eliminated while our political rivals unleashed a reign of terror with the Pakistani gun. They shifted to the Indian side only when the Kashmir militancy lost the world support after the two big terror attacks in New York and New Delhi and thereafter began seeking space in the mainstream politics", says Ramzan. According to him, Pakistan's Gen Ziaul Haq and JKLF founder Amanullah Khan started Kashmir's separatist militancy in 1978 under Operation Tupac and elimination of Sheikh Mohammad Abdullah's National Conference, which used to win maximum number of seats in all elections, was a key component of Zia's plan of separating Kashmir from India.
