Two issues:
1. Whether a new 2025 law (10-year SOL for gender-transition harm, applies to pending cases) required the trial court to revive her dismissed malpractice claims.
2. Whether fraud claims should have gone to a jury instead of being tossed on summary judgment.
Her lawyers: the legislature wrote the law to apply to cases already filed; judges don’t get to ignore it. Representations about a “male brain,” male puberty, and “medically necessary” mastectomy are fact questions for a jury.
Defendants: trial court got it right.
