I'm a former defense attorney and currently a civil liberties attorney with no political dog in this fight. I watched the video at least 10 times from different angles and at different speeds and waited to offer an opinion, which I still reserve the right to change if additional information changes the calculus.
It is very clear that the officers instigated the confrontation. The woman initially tried to wave them past her.
ICE officers have no authority to search a US citizen or arrest her (unless there's probable cause to believe she's harboring undocumented individuals, not a contention here). A woman surrounded by masked, armed men who have no law enforcement authority over her has every right to try to escape. Video shows her steering wheel is turned to the right, clearly an attempt to leave WITHOUT hitting anyone and steer clear of the officer standing towards the front of her car. That officer had time to step to the side, which is where he was when he shot her.
Even a real police officer would not have the right to shoot at her for trying to flee. This is well-established in the case law; deadly force may not be used simply to prevent someone from getting away. Given that the ICE officers had no law enforcement authority to begin with, AND the video footage shows she was trying to escape a perceived threat, not to kill anyone, the crime is all the more inexcusable.
I'm praying for the victim's family, especially her children. I'm also praying for all the conservatives who are so unprincipled and lost they're excusing this terrible crime, and gloating over a death that will leave three young children motherless, because of the victim's politics.
No condolences for the other Brown student who died, Mukhammad Aziz Umurzokov.
No condolences for Rob Reiner or his wife. No comment on his boss's disgusting statement about Reiner.
Of all the tragic killings over the weekend, the only victim who gets @JDVance's condolences is the Republican: https://t.co/45ZV8anN9v
JD “I don’t give a shit” Vance says killing people he accuses of a crime is the “highest and best use of the military.”
Did he ever read To Kill a Mockingbird?
Did he ever wonder what might happen if the accused were immediately executed without trial or representation??
What a despicable and thoughtless sentiment it is to glorify killing someone without a trial.
Obama’s Iran nuclear deal was working until Trump pulled out of it. His own staff warned him not to because the alternative was war. Well, now we’re at war with Iran because Trump is weak, stupid and hated Obama more than he cared about preventing Iran from getting a nuke.
BREAKING: President Trump walks to Marine One to head to Mar-a-Lago on the Taxpayers dime.
This trip will cost us $3.1 million, which could be used by USAID to feed 710 starving children for a full year.
Really is a tough call.
On one hand - every Nobel prize winning economist is adamantly stating that Harris has a significantly better economic plan
But on the other hand - the dumbest people I’ve ever interacted with say Trump is a good businessman
Quite the dilemma
Trump is in Racine, Wisconsin today—site of his Foxconn boondoggle and Biden’s Microsoft triumph. What happened there perfectly illustrates a key contrast in this election. 🧵
Hi.
The reason Republicans are all lining up to help Donald Trump get away with his multiple crimes is because they need him to pass a national abortion ban and tax cuts for their corporate and billionaire buddies.
In Bragg's first 15 months on the job, the Manhattan DA's office filed 166 felony counts for falsifying business records against 34 defendants from all walks of life.
I haven't heard a single Republican politician explain why they think the law shouldn't apply to Donald Trump.
A grand jury of ordinary Americans decided there was enough "specified criminal conduct" to indict Donald Trump.
Another jury of ordinary Americans decided there was enough evidence to convict Donald Trump - a jury approved by Trump and his lawyers, who were given ample opportunity to present their case, call witnesses, and get their day in court.
Is it the position of Republican politicians that they can only be tried for breaking the law if the charges are brought by Republican DAs, the case is heard by a Republican judge, and the verdict is rendered by a Republican jury?
If so, just be honest and say that.
He’s the president of the United States not the Governor of New York. He didn’t propose, pass, sign, or even support this law. He didn’t prosecute the case either.
But you know all that. You learned it at Yale Law. What stands out here is how eager you are to mislead voters.
