Imām Ibn Ḥajar al-Haytamī himself, one of the senior authoritative verifiers of the Shāfiʿī school, explicitly states afterwards:
“There is no prohibition in it if it is used for a permissible purpose. However, if it is employed in aid of something unlawful, then that is different.”
He is discussing al-awfāq specifically, not black magic in the commonly understood sense. He then explains that Imām al-Qarāfī’s statement that awfāq are from siḥr is carried upon cases where they are used for unlawful purposes.
Additionally, Imām al-Qarāfī is not some minor authority. He is among the greatest jurists and legal theorists of the Mālikī school.
There is nothing here involving seeking aid from other than Allah ﷻ, invoking jinn, calling upon spirits, or believing that anything besides Allah independently benefits or harms. Any benefit, if accepted, is only by the creation, will, and decree of Allah ﷻ.
