To the degree courts are practical, they’d see it’s unworkable.

@howserob@Megankstack Federal courts, especially SDNY, will move very quickly on the habeas petition if this happened. Like, a one day briefing schedule, release the next day, and CA2 would not issue a stay on appeal that prevents him from immediately leaving.
@howserob@Megankstack This would be a deprivation of a right. If the arrest is unlawful (which it is because he’s protected against arrest by federal law as a TPP), then they’ve deprived him of a right.
