״בתקופת בחירות, כל פרשן פוליטי ממהר להכתיר את הסוגיה התורנית כ"אירוע שיכריע את המערכה". אך בעוד המיקרופונים מתמקדים בנושאים הרגילים, מתחת לרדאר הציבורי מתגבש התנאי המרכזי של הבחירות הללו; המפלגות הערביות כבר סימנו והציבו את הקו האדום הבלתי מתפשר שלהן לכל שותפות עתידית: ביטול מיידי של רפורמת "יישור קו" בנגב. מה היא אותה תכנית שהוצבה כתנאי ולמה היא כל קריטית לעתיד הנגב?

כדי להבין, מספיק לנסוע לתצפית מעל היישוב לקיה. מדובר ביישוב שהמדינה תכננה ופיתחה עבור עשרות אלפי תושבים, אך בפועל הוא משובץ במרחבי ענק שוממים. מדוע מגרשים מפותחים, שעלות הכשרתם הגיעה למיליוני שקלים מקופת המדינה, נותרים ריקים בעוד הפזורה מסביב ממשיכה להתרחב?

התשובה נעוצה במונח אחד שקריטי להבין אותו: תביעות בעלות.

בקצרה, חלק קטן מהאוכלוסיה הבדואית טוענים לבעלות על כמליון דונם מאדמות הנגב. עד כה כל תביעה כזו שנידונה בבית משפט נרשמה לבסוף כאדמת מדינה מהטעם הפשוט שתובעי הבעלות מעולם לא החזיקו בקרקע כחוק.

קוראי מקור ראשון בוודאי יגידו שאם כך הדבר, הרי שאין בעיה כלל. הרי כל תביעות הבעלות ירשמו על שם המדינה ובכך יבא גואל. מה שקריטי להבין הוא שאנחנו לא באירופה אלא במזרח התיכון. לא רק שקביעת בית המשפט אינה חזות הכל, היא אפילו לא חזות החלק הקטן. בנגב יש מערכת חוקים מקבילה: מערכת החוקים הבדואית.

לפי החוק הבדואי- אם אתה, אביך וסבך רעיתם את צאנכם באזור מסויים- הרי שתא שטח זה הינו שלכם. מבחינת החוק במדינת ישראל אין לכך כל משמעות.

במשך עשרות שנים התנהלו ממשלות ישראל בניתוק מוחלט מהשטח ובחוסר הבנה מוחלט של "החוק הבדואי". המדינה המשיכה לתכנן ולפתח מגרשים על קרקעות שעליהן הוגשו בעבר אותן תביעות בעלות. הגם שכאמור לתביעות אלו אין כל תוקף או הוכחה משפטית בבתי המשפט הישראליים, לפי חוקי התרבות הבדואית בנגב, איש לא ייכנס לגור במגרש שבדואי אחר הכריז עליו כשלו. התוצאה הייתה קיפאון מוחלט: מיליוני שקלים נשפכו על פיתוח "שכונות רפאים" ריקות, בעוד עשרות אלפי משפחות נותרות לגור בתנאים ירודים בפזורה בלתי חוקית שהלכה ותפחה, עד שחצתה השנה את רף ה-100,000 מבנים.

כדי לשבור את הקשר הגורדי הזה, נולדה רפורמת "יישור קו" בהובלת השר שיקלי ורשות הבדואים. היא עושה דבר אחד פשוט אך דרמטי: היא הופכת את שעון החול.

הרפורמה הנוכחית הגדירה חלון הזדמנויות קצוב של חצי שנה בלבד להגעה להסכמות. תובע בעלות על קרקע שנמצאת בתוך תחומי ישוב חוקי שיאפשר לבדואי אחר לבנות בשטח, יזכה למענקים נדיבים ביותר. מי שיסרב, יראה את הפיצויים פוחתים. לאחר חצי שנה- המדינה תגרע את השטח מגבולות היישוב, צעד שיוביל לצניחה חדה בערך הקרקע. לראשונה, הזמן פועל נגד הסרבנות.

גם אנו בתנועת רגבים, מבינים את גודל השעה. על פי שורת הדין, תובעי הבעלות הללו אינם זכאים לגרגר אדמה או לשקל אחד של פיצוי על קרקע שאינה שלהם. ובכל זאת, כדי לחלץ את הנגב מהקפאה ארוכת שנים וליצור עתיד של קבע לדורות הבאים, מדובר בפשרה נחוצה. שכן הישובים הוקמו כחוק והתשתיות כבר פותחו, עם זאת, הרפורמה קובעת שסתום ביטחון קריטי: המענקים והפיצויים ישולמו בפועל רק כאשר משפחה בדואית אחרת תיכנס ותתגורר במגרש, הוכחה מעשית ויחידה לכך שהתובע אכן שחרר את הקרקע. במקביל, חלק בלתי נפרד מהפתרון מחייב את המדינה להמשיך ולפתח מגרשים חדשים לקליטת הפזורה באדמות מדינה נקיות מתביעות בעלות.

תוכנית "יישור קו" נמצאת כעת בנקודת הכרעה היסטורית, רגע לפני סגירתו של חלון ההזדמנויות. כל ממשלה עתידית שתמסמס את המהלך, תקפיא אותו או תיכנע ללחצים פוליטיים, תחזיר את הנגב עשרות שנים לאחור. בלימת התוכנית פירושה כניעה מוחלטת לכאוס, הנצחת העוני של עשרות אלפי משפחות בפזורה, ואובדן סופי של השליטה בנגב. בקלפי הקרובה, הנגב עומד למבחן, והגיע הזמן שנבחר בנגב״.

One day, a Lebanese restaurateur will have the courage to put Israeli specialties on a menu in Beirut.

Before any clever troll jumps into the comments to doubt that Israeli cuisine has anything to offer, let me remind you: it is the richest and most diverse cuisine in the world. The reason is simple. Jews lived scattered across the globe for centuries. When they built their homeland around Jerusalem, the soul of the Jewish story, they brought everything they had cooked back with them. Moroccan. Iraqi. Polish. French. Mexican. Indian. Lebanese. Yemenite. Spanish.

My neighbor's wife, Panamanian like her husband, makes me kebbeh whenever they invite me for Shabbat. Hers has pistachios in the filling, just like her mother and grandmother made it in Aleppo.

One day, more people from hostile countries will be able to enjoy Israel as I do. You will see how much you've missed all these years. Not just the food. The warmth. The welcome. Real friendship and genuine people.
