If someone is punching you and you are aware theres a police presence but still use lethal force (disproportionate force) against your assailant you might not get self defense

So just like in this case if his words aren’t protected free speech a jury would be even more likely to see them as fighting words and convict him

I think you don’t understand how the fighting words thing works it’s up to the jury and is very contextual but in this case a jury would likely call them fighting words
