#Telangana HC- Bar can protest but cannot stop other advocates from appearing for their case-

HC has closed contempt proceedings against office bearers of the Metropolitan Criminal Courts Bar Association Nampally, , while making it clear that advocates have no right to strike or forcibly stop colleagues from attending court.

Justice Alishetty Laxmi Narayana passed the order on Tuesday, on a contempt petition filed by Advocate @VijayGopal_ , who appeared as a party-in-person against N.V. Ramana Goud and other bar office bearers.

The case arose from an incident on June 16, 2025, when the MCCBA passed a resolution calling for a one-day court boycott. Gopal alleged that when he went to attend a scheduled hearing before the XVII Additional Chief Judicial Magistrate at Nampally, some advocates obstructed him and assaulted him before he was taken into police custody.

Though Vijay Gopal was eventually allowed to enter the court and present his case, he approached the HC seeking contempt action against the bar representatives. He relied on the Supreme Court's ruling in Ex-Capt. Harish Uppal v. Union of India and argued that the boycott and alleged physical obstruction amounted to interference with the administration of justice.

Court issued a strong caution to Bar associations, stressing that protests must be conducted within the limits of law. No advocate, litigant or member of the public can be subjected to violence, obstruction or coercion for exercising the right to access the courts.
