In a key exchange in the 1866 Senate debate, Sen. Reverdy Johnson asked why the offices of president and vice president had been omitted from Section 3 of the 14th Amendment.

Sen. Justin Morrill quickly clarified: "'Let me call the Senator's attention to the words 'or hold any office, civil or military, under the United States,' Morrill said, ending the discussion on that point."

A second quote sheds light on another major question the courts have grappled with: Was Section 3 a prospective prohibition for insurrections yet to come?
