LIBERTY MUTUAL DISCOVERS “BAD FAITH” IS EXPENSIVE WHEN A JUDGE DOUBLES IT
Liberty Mutual Insurance and its affiliates just got introduced to a very old concept: if you’re meant to settle a claim within policy limits, you don’t play chicken.
A Massachusetts Superior Court judge ordered roughly $90.97m after finding the insurers violated Ch. 93A and 176D by refusing to make a reasonable settlement offer once liability was “reasonably clear”.
The underlying case was a $26.6m jury verdict that ballooned to over $45m with interest and costs, then got doubled because the court found the conduct willful.
The reported numbers read like an insurer’s business plan written in crayon: offer $350,000, drag it out, ignore inconvenient facts, then act shocked when the statute does what it says on the tin.
When your claims strategy is “three wise monkeys”, don’t be surprised when the bill arrives with extra zeroes.
Turns out “delay and deny” is a lot less cute when the court adds “and pay double”.
