The Office of Renewable Energy Siting (ORES) attempted to deny a town and county from accessing documents related to Cow Bell Solar in the Town of Florida this past summer.
Meghan M Manion, Montgomery County attorney, filed for a protective order to review the materials. Although initially granted, the solar developer petitioned ORES to deny the county's request. ORES quickly agreed with the developer.
Upon learning that the county had granted Manion permission to file a lawsuit over Cow Bell Solar, suddenly, ORES posted this week that they will "re-review" the protective order decision.
The article out in the Daily Gazette this week quotes Manion: “I think the fact that ORES is taking this under their own review, prior to having this addressed in Supreme Court, is a sign that there are serious concerns about the decision-making process that was made in determining that Montgomery County was not allowed access to unredacted documents,” Manion said Tuesday.
She goes on to say: “Government is based on the pillar of open access to documents and to deny a municipality documents in an active proceeding that directly involves that municipality goes against all of the tenets of law that we follow in New York State,” Manion said.
We are living in crazy times when county attorneys have to be the ones to tell our state how the government was supposed to function. That's what happens when bureaucratic bloat has consumed every office out of Albany, New York.
Since we're all watching, posting, documenting, and suing, ORES has no choice but to react to the publish pushback.

Why does everyone else out in rural-residential or zoned agricultural areas have to following local zoning, but foreign solar and wind companies can depart from that zoning for industrial buildouts?
This is the "take" that's going on across New York State, where patchworks of 20+ parcels are allowed to break zoning everyone else in the area has to follow.
It's why property values plummet if you live near one of these ecological detention zones.
Last week at the NYS Senate Energy ORES Roundtable, residents from around the state talked about how no one can sell their homes if they end up near an ORES complex.
Would you buy a property and look at this view out your back window? People are in rural areas for peace/quite, viewsheds, history, ability to grow their own food, and the predictability that comes with rural zoning.
You're allowed to do what you want with your property in this country... to an extent. Zoning exists to create uniformity and predictability in a region. It guarantees a certain property value for those around you. It's why you can't decide tomorrow to build a Walmart in your backyard (Mind you, Walmarts are about 20 acres, total, in size. These complexes are 1,000+ acres.).
If these complexes were being built in zoned commercial/industrial areas, between highways, and over parking lots, you wouldn't hear the outcries that are pouring from rural New York towns statewide.
Hard-working New Yorkers who have invested in their properties, land, habitats, views, and culture are being financially destroyed by bureaucrats in Albany who have never, in their lives, set foot in our rural villages. That's the problem here.
New York Democrats have declared WAR ON THE AMISH. Thanks to their unconstitutional attack on religion, they're now able to fine EACH unvaccinated Amish child $2,000 EVERY SINGLE DAY.

The $118,000 bill is one day, not the cap. Three one-room schools alone already owe that much for 59 children, at $2,000 each.

Health Commissioner Mary Bassett imposed it on December 15, 2022. She called the sum conservative because it assumed only one day out of compliance.

Dygert Road was billed $52,000 for 26 children. Pleasant View was billed $46,000 for 23.

Shady Lane was billed $20,000 for 10.

Footnote 9 of the Second Circuit opinion records the state's view. Each day an unvaccinated student attends is a fresh violation and a fresh $2,000 fine.

Another day for those 59 children is another $118,000. A 180-day year at that rate is about $21 million, and the families say they cannot pay the first bill.

Joseph Miller, Jonas Smucker, and Ezra Wengerd run the schools. The schools sit in Clymer and Heuvelton, plus the Canajoharie settlement, and take no public money.

They had a religious exemption for decades. On June 13, 2019, Democrats repealed it after measles spread through Orthodox Jewish neighborhoods in Brooklyn and Rockland County.

Governor Andrew Cuomo signed the bill. Governor Kathy Hochul left it in force.

A parent may not excuse a child for faith.

Senator James Skoufis said the exemption was made up and fake. Assemblyman Jeffrey Dinowitz called it utter garbage.

Counsel Aaron Siri told the New York Post the families can pay only if the state takes their land. Some in the community have talked of leaving the state.

The case is Miller versus McDonald. The Second Circuit ruled against them on June 30 in 2026.

A Supreme Court petition was due around September 28.

New York State doesn’t just stop with ignoring religious exemptions for the Amish… they’re also forcing solar/wind complexes into the middle of Amish communities through ORES.
The Amish get around on foot or by horse and buggy. Fragmenting their communities with 2,500 acre solar complexes is catastrophic for them.
An expert Anabaptist study on the Amish of Montgomery County was uploaded to the Mill Point Solar docket.
ORES ignored it.
The state wants to push the Amish out. You want to ask yourself why that is today.
I won’t stand for it! As was detailed for Montgomery County, having the Amish pull out would bottom out the countywide economy. They are an incredibly industrious, productive, and agricultural people that we NEED badly in New York State.
ORES also fails to properly inform the Amish about incoming solar complexes, cutting them out of the conversation. It’s disgusting.
