Ok let’s break it down.

You’re deployed to work alongside @TfL revenue inspectors because you’re part of the #SaferTransport command which is funded by @TfL for this very reason, partly because revenue inspectors *do not* have a power of arrest. @TfL is also run by @MayorofLondon who is the Police and Crime Commissioner for London, in case you didn’t know.

Whilst on a deployment, someone is identified by a revenue inspector as having not paid their fare and when required to do so has not produced their ticket to prove they have paid.

There’s also signs all over buses telling you you’re liable for a fine if this happens.

So now the Police Officers have to make a decision.

Option one - calmly explain to the person to show their ticket and provide their details to the revenue inspector and the matter can be resolved.

If the person refuses, then what? Sadly it looks like moving to an arrest stage. A suspect has been identified for fare evasion. Will not provide their details, so now an arrest can be made under S24 PACE 1984 *because* there are reasonable grounds to suspect an offence has been committed *AND* the suspect will not provide their name and address.

Why is the name and address important? It is part of CODE G of our necessity to arrest. If we know who you are and where you live and the offence is only summary (for example which this is), you could be required to attend a caution plus three interview at a later day or in this instance summonsed to court or sent a penalty notice for disorder. But without a name and address, this is impossible.

So if the arrest stage is necessary, the Officers have a sub section of PACE conferred on to them to use reasonable force, S117 PACE 1984 in relation to the arrest under S24 PACE 1984. In this case to prevent someone from escaping, who will not provide their details and needs to provide their account under tape recorded interview at a Police Station.

One of the simplest ways to prevent someone escaping is to use an ordinary Police Hold, quite literally holding on to someone’s arm, however that can be broken free from. So handcuffing provides another layer of compliance for someone who is pulling away and trying to get away from you, which I would argue in the circumstances would be considered reasonable.

Now, we also have a wonderful option called de-arresting. If someone suddenly provides their details or proves that they weren’t involved in an offence - they can be de-arrested as there is no longer a necessity for that arrest under CODE G of PACE. This happens regularly and Officers will complete a use of force form and an MG11 to cover the arrest and de-arrest and any use of force as well as saving their body worn video.

Respectfully as a member of the public with no Legal or Policing back ground you probably didn’t know any of this.
