Kenya’s Defining Choice: Uphold Refuge or Succumb to Political Pressure?

The ongoing detention of Ahmet Mustafa Güngör, a Turkish refugee, educator, IT professional, and father who has built a peaceful life in Kenya for over fifteen years poses a stark and urgent question: Can the foundational promises of international refugee protection withstand intense, real-world political pressure?

Güngör is a registered refugee with valid documentation issued under Kenya’s asylum system and UNHCR mandate in December 2024. He has no criminal record in the country and has been a contributing member of society, serving as IT manager at Light Academy Schools since 2011. Yet, on the night of December 20–21, 2025, his family’s home was subjected to a midnight raid by Kenya’s Anti-Terrorism Police Unit (ATPU).

The operation, initiated following a Turkish government request via mutual legal assistance channels, led to the arrest of Güngör, his wife Zeliha, their two daughters, and his in-laws. While his family was later released, Güngör remains in custody at ATPU headquarters.

The Kahawa Anti-Terrorism Court, under Principal Magistrate Gideon Kiage, has postponed until December 30 a ruling on a prosecution application to extend his detention by 15 days. The stated aim is to investigate allegations tied to a single social media post from 2018.

On the surface, this may appear to be a routine investigation. In reality, it aligns with a well-documented and dangerous pattern in Kenya, where counter-terrorism legal frameworks are increasingly misused to lend a veneer of legality to politically motivated operations targeting refugees and dissidents. This practice places individuals at severe risk and undermines the integrity of Kenya’s judicial and protection systems.

Kenyan courts have a record of rejecting extradition requests deemed unfounded or politically motivated. However, judicial rulings have not always served as a reliable firewall against harm. In a high-profile 2021 case, a court explicitly barred the deportation of an individual, who subsequently disappeared under disputed circumstances. More recently, in October 2024, four Turkish refugees under UNHCR protection were forcibly returned to Turkey without ever being presented before a court an act widely condemned by human rights organizations as a flagrant violation of the principle of non-refoulement.

Kenya is bound by this principle under the 1951 UN Refugee Convention, the 1969 OAU Refugee Convention, and its own domestic 2021 Refugee Act. The principle is eroded not only by physical removal but also by indefinite detention under duress, which can itself be a precursor to refoulement and a tool to circumvent legal safeguards.

Kenya now stands at a critical juncture. The handling of Ahmet Mustafa Güngör’s case represents a defining test of its commitment to the rule of law and its international obligations. Will it protect a long-term resident who has integrated and contributed to society, or will it allow its legal institutions to be instrumentalized by a foreign state for political ends?

Amnesty International is deeply concerned that Mustafa Güngör who was arrested with his wife Zeliha, daughters Seniha Betül and Zeynep, and his in-laws Zümrüt and Salim is at serious risk of refoulement to Türkiye, where he could be subjected to arbitrary detention, torture, or ill-treatment. We have reliably learnt the Turkiye authorities sought his arrest through a Mutual Legal Assistance request to office of the Attorney General. Kenya has an obligation under international law not to return anyone to a country where they face persecution or harm. We call on the @DCI_Kenya and both authorities to: 
✅ Respect the legal principle of non-refoulement 
✅ Ensure due process and protection for family 
✅ Allow continued access to legal representation and UNHCR and @Kenyajudiciary
