NBA NEC CONDEMNS MISUSE OF CRIMINAL PROCESS IN CIVIL AND DEFAMATION MATTERS

The National Executive Council (NEC) of the Nigerian Bar Association (NBA), at its meeting held on Thursday, 7 May 2026 in Awka, Anambra State, adopted a resolution condemning the increasing misuse of criminal law enforcement mechanisms in disputes fundamentally civil in nature, particularly matters relating to defamation and reputational injury.

NEC considered recent reports involving the arrest of individuals over a viral social media publication concerning businessman Mr. Tony Elumelu and expressed concern over the growing tendency to deploy police powers in matters that ought properly to be resolved through civil legal processes.

The Council emphasized that while false and defamatory publications may give rise to legal consequences, civil remedies such as defamation proceedings provide lawful and adequate avenues for redress without resort to arrest, detention, or criminal prosecution.

NEC warned that the criminalisation of essentially civil disputes undermines constitutional safeguards, including the rights to personal liberty, freedom of expression, and fair hearing.

The Council further noted that the abuse of police powers in civil disputes risks creating a chilling effect on lawful expression and public discourse.

NEC therefore called on law enforcement agencies to exercise restraint and ensure that criminal processes are not improperly invoked in matters that do not disclose recognised criminal offences under Nigerian law.

The Council also demanded the immediate release of any person arrested solely in connection with such publications where no lawful criminal offence has been disclosed.

This Palm Sunday, reports from Nigeria indicate that at least 10 Christians were martyred in the city of Jos. Radical Islamic terrorists opened fire on the Christians before hacking them to pieces with machetes.

This is sickening and unacceptable, but it’s not surprising.

This tragedy follows a pattern of radical Islamic terrorists massacring Christians on Holy Days. In fact, terrorists have attacked Christians in Nigeria on every single holy day in recent memory, except for last Christmas — when President Trump sent 12 tomahawk cruise missiles to stop them.

Abuja knows this pattern and they must massively ramp up security for the Tridduum and Easter. If they don’t take this threat seriously and mobilize to defend our brothers and sisters in Christ, blood of these martyrs will be on their hands, and there will be significant consequences for Nigeria’s relationship with the United States.

The Nigerian Army personnel in this video was captured alive by Boko Haram Islamic terrorists and had one of his legs cut off. Till today, @HQNigerianArmy has not provided any update to Nigerians about his condition or whereabouts. Everything was swept under the carpet as if nothing ever happened.

Yet the same system is asking Southeast youths to enlist into the army, while some so-called security experts are online telling their followers that all is well in the Nigerian Army.

How can everything be “well” when soldiers are captured, mutilated by terrorists, and the institution responsible cannot even account for them or properly inform the citizens?

If this is how the lives of soldiers are treated, who exactly are they expecting to risk their lives by joining?

This is exactly the problem.

A man has allegedly been languishing in Kirikiri since 2019 over a false rape accusation, and your first instinct is to turn it into a gender talking point? “Nigerian men’s help are needed”? Justice is not a male responsibility or a female responsibility. It is a societal responsibility.

A “woman” lied and an innocent man’s life wasting away behind bars, this is not a moment to score points or lecture men. This is a moment to demand accountability, legal urgency, and moral consistency. Rinu, you cannot claim to fight for justice, while framing an innocent man’s suffering as something “men should fix for themselves.”

This is not about feminism. It’s not about men. It’s about an innocent human being sitting in prison for six years. You cannot claim to stand for fairness and equality while distancing yourself the moment the victim is male.

In 2017 I observed that people will say anything, just anything to trend, and as a reaction to that I wrote the post below on FB.

Everything I wrote 9 years ago is now so timely in the light of the “Simi Files.” I don’t know if she did or meant the things she wrote, we might never know…but this will even be more painful if she were only “catching cruise” back then. Whatever the case is, it is a lesson for e-dwellers.
