The three-year prison sentence handed down today by the Banadir Regional Court against Sadia Moalim Ali (Sacdiya Bajaaj) is deeply troubling and fundamentally unjust.

This politically motivated arrest and conviction, carried out at the direction of Hassan Sheikh Mohamud, reflects a disturbing pattern of judicial overreach, political retaliation, and abuse of state authority.

It stands as further evidence of the extent to which the Banadir Regional Court has, in the eyes of many observers, been compromised and utilized to advance the political objectives of an administration whose constitutional mandate has expired.

Sadia is not a criminal. She is a Somali citizen, a university graduate who, despite her qualifications, was unable to secure formal employment. Confronted by harsh economic realities, she turned to driving a rickshaw (bajaaj) to support herself and provide for her family, demonstrating resilience and determination in the face of adversity.

Rather than creating opportunities for citizens like Sadia or enabling them to contribute meaningfully to society, the state has chosen to criminalize her. Her imprisonment stems solely from the peaceful expression of her views and grievances, a right explicitly protected under Article 18 of Somalia's Provisional Constitution, which guarantees freedom of expression.

It is a grave concern for any nation when the judiciary, entrusted with safeguarding justice and the rule of law, is perceived as an instrument of repression. This ruling risks undermining the credibility of the Banadir Regional Court and further eroding public confidence in Somalia's judicial institutions.

It is a national tragedy when the judiciary, the ultimate custodian of justice, becomes an instrument of oppression. This ruling severely undermines the integrity of the Banadir Regional Court and erodes the public's trust in the entire judicial system.

This heavy-handed sentencing is a transparent attempt to intimidate and silence ordinary citizens exercising their constitutional right to free speech. However, history demonstrates that the Somali people will not acquiesce to a governance model built on coercion, arbitrary detentions, censorship, and fear methods that have repeatedly failed in our nation's past.
