In a significant decision for healthcare providers and medical negligence jurisprudence in Uganda, the High Court dismissed a claim against Kampala Hospital arising from conflicting Hepatitis B test results, reaffirming that adherence to accepted medical practice and the use of NDA-approved testing kits do not amount to negligence merely because screening results are later contradicted by confirmatory tests.
The judgment reinforces the application of the Bolam principle, emphasizing that medical practitioners will not be found negligent where they exercise ordinary skill and act in accordance with practices accepted by a responsible body of medical professionals. It also highlights the importance of following established testing protocols, recommending confirmatory testing, and maintaining comprehensive records.
