*The Hamas Prisoners Faction*
One of the most important facets of the Hamas consultations that elected Khalil al-Hayya was the participation of the prisoners faction as a separate body.
Hamas’ four constituencies within its Consultative Body (majlis ash-shûrâ) and Political Bureau (maktab al-siyâsî) consist of: Gaza, West Bank, prisons, and diaspora. According to Hamas scholar Leila Seurat, in the occupation prisons, Hamas is made up of twenty-three members.
The 2021 elections presented an issue for the prisoners' participation. In December 2020, Hamas completed the election of a new leadership for the “Supreme Leadership Committee” in the occupation's prisons, resulting in prisoner Salama al-Qatawi being elected chairman, prisoner Abd al-Nasser Issa as his deputy, and 13 prisoners as members representing the movement’s prisoners in various prisons. A senior Hamas source revealed that the prisoners were, at this point, demanding that the prisons be recognized as a “fourth region” in the movement’s then forthcoming elections, and that the elected chairman of the committee automatically become a member of the new Political Bureau, while his deputy would become a member of the General Shura Council. That is, prisoners would have a representative on the Political Bureau, although the movement’s bylaws stipulated that the committee’s chairman and deputy chairman represent the prisoners in the Shura Council. A prominent Hamas leader in the West Bank and Minister of Prisoners’ Affairs in the 10th government, Wasfi Qabha, defended the prisoners’ right to representation on the Political Bureau. Qabha expressed his dissatisfaction with the representation of prisoners, remarking that “It is unacceptable for prisoners to have no representative, and for those representing the West Bank to be members residing outside it.”
A retrospective published by Felesteen on August 4, 2021, stated that Hamas’s six-month electoral process proceeded through its three regions—Gaza, the West Bank, and abroad—after the movement had completed the selection of its leadership body in the occupation prisons.
During the August 2024 emergency elections, the prisoners faction was unable to participate. Ultra Palestine’s 28 December 2025 reporting described the General Consultative Council then being assembled as a 71-member body drawn from the three regional consultative councils—Gaza, the West Bank, and abroad—plus ten representatives of the military wing and ten additional members drawn from the regions. It did not list a separate prisoners’ delegation or prison consultative council. The same report said the elections would reveal the heads of the movement’s “three regions”: Gaza, the West Bank, and abroad. (In January 2021, it had reported that the prisoners constituted "al-dāʾira al-shūriyya al-rābiʿa"—“the fourth consultative constituency”—after the external, Gaza, and West Bank constituencies, and that they were demanding their own seats in both the Political Bureau and the General Consultative Council.)
According to Hamas' communiqué published today, “our heroic prisoners in the occupation’s jails who participated in this consultative process [leading to al-Hayya's election] was despite the significant restrictions,” before the movement affirmed that “the prisoners’ cause and their release will remain at the top of its priorities.” This is an important step in the democratic Shura process that heralds the prisoner faction's autonomous representation.
