But if the circumstances and conditions in shelters remain as they are currently, then in turn this by-law must be struck down as a result of infringing on the pressing and substantial right to life, liberty, and security of the person under s. 7.

If we want to continue to uphold the right to evict tent encampments from public spaces, then we must provide appropriate and adequate shelters and housing for these individuals that are safe, comfortable, sanitary and easily accessible.
