@eskimmin @sebm2431 @OJEN_ROEJ Again, legally there is no standard to which the government is bound to uphold. By insinuating we are not providing alternatives begs the question on what you mean by “proper” and which legal source you are drawing from to make this definition. #OJENROEJSP22 @OJEN_ROEJ

survival is not being neglected. In Canada everyone has the right to life but there is no right to a standard of living. Furthermore judge Goodman already ruled that there is sufficient room in shelters. It is not necessity but a choice to encamp @OJEN_ROEJ #OJENROEJSP22

@sebm2431 @OJEN_ROEJ However the encampments are not the only option available for shelter. It isn’t necessary to do nothing and allow camping in public areas that make tax paying individuals feel unsafe.

[Dea Meadows @meadows_dea1]

@sebm2431 @OJEN_ROEJ Under ICESCR yes, however that doesn’t change the fact Government is not responsible to uphold any standard of living in the charter of rights and freedoms @OJEN_ROEJ #OJENROEJSP22 @ProvostLaw

[Dea Meadows @meadows_dea1]

@griffinslaw22 @OJEN_ROEJ It doesn’t matter what I think when statistically drug use, crime, sexual assault and other issues are greater in encampment areas. @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

one must consider that the same issues people argue make shelters inadequate also exist in encampments, if not more so. No issues are solved by letting them stay, and additionally citizens living around these feel less safe as a result.(10) #OJENROEJSP22 @ProvostLaw @OJEN_ROEJ

[Dea Meadows @meadows_dea1]

@OJEN_ROEJ #OJENROEJSP22 @ProvostLaw The question remains whether or not the infringements on the 15 and 7 charter rights by the hamilton bylaws to evict people encamping in parks are justified under section 1. (1)

[Dea Meadows @meadows_dea1]

@OJEN_ROEJ #OJENROEJSP22
@ProvostLaw It is important to note that the objective of these bylaws is for the benefit of the majority in society: Keep public areas open for recreational use for everyone, Keep areas safe and sanitary, protects you possibly from dangerous land uses(2

[Dea Meadows @meadows_dea1]

In Canada one has the right to life but not to a standard of living. Arguing therefore that the standard living in shelters are inadequate forcing homeless people to living inparks is legally invalid to justify living on public domain.(9) @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

Firstly, Judge Goodman in Poff v. Hamilton line 236 ruled that there is sufficient space available at these shelters and individuals encamping are doing so by choice, not out of necessity as some will make it seem. (8)@ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

a counter argument commonly made is the fact that there is not sufficient room in these shelters and there is extremely poor standards of living. People complain of rampant spread of covid and the unsanitary nature of these livingspaces. (7) @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

Majority of society are not homeless and they should be able to enjoy the areas paid by their tax dollars without fear for their own safety making this infringement justified. (6) @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

Furthermore, by letting them stay is infringing on the people living around these recreational areas, you are encroaching on their section 7 right to feel of security and safety. (5) @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

Letting them camp their statistically makes it less safe, misuse of land happens more, etc, creating more problems. Therefore these infringements are justified because it is how the best interest of majority in society is met. (4) @ProvostLaw @OJEN_ROEJ #OJENROEJSP22

[Dea Meadows @meadows_dea1]

It’s unquestionable that issues of mental illness, drugs, crime, and sanitation are rampant in these encampments. Therefore, You can't meet the objectives of the bylaws created for the benefit of society without infringing on their rights. (3)@ProvostLaw @OJEN_ROEJ #OJENROEJSP22
