@OrinKerr (2/2) Arrest of Mark: unless he was committing a crime (e.g., obstruction), this was an illegal arrest.
Officer's testimony tossed, drugs suppressed, cocaine from Mark's pocket suppressed. Fruits of search suppressed (fruit of poisonous tree).
@OrinKerr Peering into townhouse raises issue of whether officer was in a lawful position to view the contraband, home's curtilage.
Woman's consent to search was not voluntary but under threat, and no valid SW. Also, no authority from owner to search residence. 1/2
@Helyeh_Doutaghi "Her research explores the intersections of the Third World Approaches to International Law (TWAIL), encompassing Marxian and postcolonial critiques of law, sanctions, and international political economy." Yeah, you were clearly going to be a target of Trump.
@Timodc@IAmPoliticsGirl Have to admit it’s pretty scary to think you’d have to go to that prison as an option. American federal prisons are bad enough, but Lordy Lordy.
@Theresa49500@bluestein If that was a problem for defense attorneys, there would be no one to defend persons charged with crimes. Our Constitution provides every person charged with a crime certain rights. We force the Government to prove their case. That’s the beauty of our system.
