COURT OF APPEAL - JUDGMENT NOT ABOUT PDP LEADERSHIP, BUT NOMINATION OF GOVERNORSHIP CANDIDATE FOR OSUN ELECTION

1. The Peoples Democratic Party (PDP) has noted with concern the misleading reports and commentaries following the judgment delivered by the Court of Appeal on Thursday, August 13, 2026, concerning the Party’s participation in the Osun State Governorship Election scheduled for Saturday, August 15, 2026.

2. Our concern is not with the decision of the Court of Appeal, but with the deliberate attempt to misrepresent the scope and effect of the judgment for political purposes.

3. In particular, there have been attempts to portray the judgment as a judicial endorsement of a group of individuals led by Kabiru Tanimu Turaki, who claim to be members and leaders of our great Party, the PDP.

4. For the avoidance of doubt, the question of who constitutes the legitimate leadership of the PDP has long been settled and was not one of the reliefs sought by the plaintiffs in the suit that culminated in the Court of Appeal judgment.

5. It is therefore important to maintain a clear distinction between the issues surrounding the Osun governorship nomination and the separate leadership dispute within the Party. These involve different questions, processes and legal considerations.

6. Consequently, the judgment cannot properly be presented as a declaration validating, conferring recognition upon, or legitimising the so-called “Turaki group,” either as the present or future leadership of the PDP. Accordingly, any statement purported to have emanated from or issued by this group should be disregarded in its entirety, as such claims amount to nothing more than wishful thinking.

7. It is also important to remind Nigerians that, based on the records available at Wadata Plaza, the national headquarters of our great Party, Governor Ademola Adeleke was the only aspirant who purchased the Party’s Expression of Interest and Nomination Forms and was screened and cleared to contest the governorship primary scheduled for December 2, 2025.

8. At that material time, all notices relating to the primary election had already been duly communicated to the Independent National Electoral Commission (INEC) on October 27, 2025. Those notices were signed by the then National Chairman, Ambassador Umar Iliya Damagum, and the National Secretary, Senator Samuel N. Anyanwu, and NOT by Kabiru Tanimu Turaki.

9. However, following the deepening crisis within the PDP, which became more pronounced from November 1, 2025, Governor Adeleke withdrew his aspiration. Consequently, the PDP was left without a candidate for the August 15, 2026 Osun State off-cycle governorship election.

10. Surprisingly, If yesterday’s Court of Appeal judgment, (which the Party only became aware of the existence of the suit after the judgment was delivered) is now being interpreted as having produced or recognised a PDP candidate, several fundamental questions arise:

a. What nomination process produced the candidate?
b. When was the process conducted?
c. Who conducted it?
d. Under whose authority was it conducted?
e. When was the nomination submitted to INEC?

11. These are factual and procedural questions that cannot be answered by headlines, political statements or deliberate misinterpretations of a court judgment.

12. The PDP respects the judiciary and accepts that whether the Court of Appeal was right or wrong in its decision is ultimately a matter that can be determined by the Supreme Court, being the apex court of the Federal Republic of Nigeria.

13. The PDP therefore urges members of the public, party members and media organisations to carefully distinguish between the litigation concerning the Osun governorship nomination and the broader question of the legitimate leadership of the PDP, a question that has already been settled.

14. Therefore, it is mischievous and misleading for anyone to use the Court of Appeal judgment on this matter as
