@Jalopnik As the General Counsel of Tesla at the time and the person who brought the case, @harrismonkey is correct - there was substantial evidence the road tests were faked. The case was dismissed because the court found no evidence that the episode caused a buyer not to purchase a Tesla

@Aggboy55 @OrinKerr @AaronMehta If there were (and we don't know that there was), it would not be a violation of a statute but a breach of contract that would allow the counterparty to seek damages against the disclosing party. But wouldn't be "against the law" as most think of that.

@matt_levine (Think of it this way - why does Elon call out a junior lawyer who took his deposition at the SEC and then went to Cooley? Is it simply vindictiveness? (Partially). But more to chill future regulators from challenging him. Similar dynamic at play now.)
