―海外カードブランドが国内の表現流通を上書きする問題―

日本国内で合法に制作・販売されているコンテンツが、海外カードブランドの私的規約によって、事実上流通できなくなる。

これは単なる決済会社の判断では済まされない。

現代のオンライン取引において、クレジットカード決済は社会インフラに近い。

VisaやMastercardに拒否されれば、合法な作品であっても販売は極めて困難になる。

もちろん、違法コンテンツを排除することに異論はない。

盗撮、リベンジポルノ、実在人物の無断性的ディープフェイク、児童性的虐待物、詐欺、マネーロンダリング、違法取引、未成年への成人向け販売は厳格に排除されるべきである。

しかし、問題はそこから先だ。

成人した利用者が、成人向けとして区分された完全フィクションを購入することまで、海外カードブランドが「ブランド毀損」「成人向けリスク」「国際基準」といった曖昧な理由で妨げるなら、それは私企業による実質的な表現規制である。

現実の被害者がいる違法コンテンツと、現実の被害者がいないフィクションは明確に分けなければならない。

表現の可否は、日本の法律、裁判所、レーティング、年齢確認によって判断されるべきであり、海外カードブランドの私的規約が日本法を上書きしてはならない。

この問題の本質は、アダルトコンテンツの是非ではない。

一度、決済会社が合法な表現の内容に踏み込むことを認めれば、その対象は性的表現に限られない。

政治的表現、宗教表現、暴力表現、風刺、歴史認識、差別表現とされるものにも広がり得る。

外部団体が圧力をかけ、決済会社が評判リスクを恐れ、プラットフォームが過剰に削除する。

そんな構造が定着すれば、表現市場は法律ではなく、決済インフラの私的規約に支配される。

日本は、漫画、アニメ、ゲーム、同人文化を世界に誇るコンテンツ国家である。

その国が、自国の法律で合法とされる表現の流通を、海外カードブランドの判断に委ねるなら、それは文化主権の放棄に等しい。

政府はただちに、決済拒否の理由開示、異議申し立て制度、国内法優先の原則、決済インフラの中立性を法整備すべきである。

合法な表現の流通を守れない国は、コンテンツ国家とは言えない。
