One bizarre consequence of Trump’s proclamation on H1B visas (assuming it somehow holds up in court, which seems uncertain to say the least) is that it will likely create a two-track H1B system. Because the legal authority invoked for the proclamation only covers “entries” into the country (i.e., 8 U.S.C. §§ 1182(f) and 1185(a)), it legally cannot affect adjustments of status for people already in the U.S. (e.g., an F1 student applying for an H1B without ever leaving the country). At the same time, it makes H1B applications enormously expensive for people physically abroad.

In the former category, you might eventually get a class of H1B holders who, having entered through some other visa category that allows them to apply for H1Bs (not B visas, presumably, but probably F and J visas), never leave the country until either the proclamation is voided by a future administration, or they get permanent residency. The weirdest thing is that the proclamation might actually make it easier for those people to get H1Bs, because it makes it so much harder to enter the H1B lottery from abroad (e.g., from South Asia).

Inspirational. Her novel Human Acts is my favorite. It discusses humanity and dignity in the face of state/institutionalized violence and reflects on the connotations and consequences of collective suffering. Absolutely visionary and congratulations!
