When my phone extraction was intentionally given to @DoctorTurtleboy by Brian Tully, it was considered discovery for his case with the "House Defendants", NOT his charges involving me. And because I was considered a non-party to that case, I had to get special permission from the judge to be able to tell him what was happening with my extraction. I wasn't allowed to inform him of what was occuring by sending him an email or contacting him ex-parte. I was required by law to obtain permission to submit pleadings to the court and, once granted, said permission was docketed on the case so the clerks were aware that I was allowed to do so. Once this happened, anything I submitted to the judge also had to be sent to the prosecutor and the defense attorney. Never would I have been allowed to reach out to the judge privately and let him know what was occuring, regardless of how outrageous it was.
These rules are in place for a reason. The fundamental right to a fair trial depends on them.

It's absolutely mind-boggling to me that someone either contacted Judge Gildea, or he himself obtained information from social media, and that information wasn't also shared with the attorneys. Ex-parte information being supplied to the fact finder and decision maker, without an opportunity to be challenged by the attorneys, completely destroys public trust in the justice system.

Nothing should shock us anymore, but for a judge that so recently was speaking about subpoenas needing to mean something, how can he not believe that the Massachusetts Code of Judicial Conduct and a citizen's right to due process should mean something as well?
